About The Suing Game:

Order Mr. Carron's book, THE SUING GAME: PREVENTING AND SURVIVING CLASS ACTION DISCRIMINATION SUITS.

THE SUING GAME is a how-to book for preventing and surviving class action discrimination suits.

Class action discrimination suits have brought otherwise successful companies to their knees. Such lawsuits often have their greatest impact outside the courtroom--in the court of public opinion. Brand names that took years and millions of dollars to build have been trashed in days. The companies often seem surprised to be sued, and even more surprised at the public's interest and apparent acceptance of the allegations. Attacked publicly, these companies often respond aggressively and ineffectively, making the situation even worse. Expensive settlements usually ensue, without any actual proof that the company had discriminated. Besides the financial cost, these lawsuits, even after settlement, can severely disrupt employee relations--particularly with those employees who do not benefit from the settlement. Additional lawsuits often follow. Customers and other stakeholders may not forgive the company for the underlying discrimination (however unproven) or for the way the matter was defended. In THE SUING GAME, Mr. Carron gives useful advice on how to prevent discrimination suits, and if sued, how to survive the attack. Mr. Carron explains how companies, just like individuals, can learn and practice respect for differences--and thereby defuse the discrimination bomb, while creating a workplace that is fair to all.

Here's what people are saying about THE SUING GAME:

"When the senior employment attorney for a Fortune 10 company spells out how to avoid discrimination class actions--and how to survive them if you get them--CEOs should listen. This book is full of excellent, practical advice on how to make the modern workplace fair." --Deval L. Patrick, Governor of Massachusetts; former head of the Justice Department's Civil Rights Division, Vice President and General Counsel of Texaco and Executive Vice President and General Counsel of The Coca-Cola Company.

"The employment law revolution is alive and well in the United States. The question is not whether your organization will be sued but when, by whom, upon what basis and how often it will happen. Mr. Carron's insights into this reality and his suggestions for the adoption of pro-active, preventive employer of choice policies and procedures are practical, useful and essential for any business today." --Michael J. Lotito,  2000 Chair,  Society for Human Resource Management and partner,  Jackson Lewis,  a national labor and employment law firm.

From the Introduction to THE SUING GAME:

Accusations of discrimination against a business are like a neutron bomb. The assets on the balance sheet may remain intact, but the company's goodwill--and its viability--can be devastated. Sometimes the company's attitudes toward minority customers are challenged as discriminatory. Sometimes the issue is the company's treatment of its employees. Sometimes unions exploit such disputes to help organize employees. Sometimes there really was discrimination; sometimes there was not. Sometimes the alleged discrimination leads to a lawsuit, and sometimes the company wins the court litigation. Usually, there is a pre-trial settlement. Curiously, it rarely matters whether the company was right or wrong. The publicity surrounding the alleged discrimination often seriously and permanently disrupts relationships with customers, investors, and employees. THE SUING GAME offers conversation-style case histories of three fictional companies which have been the victims of allegations of discrimination. The common tragedy in all three cases is that the company's management--especially top management--misunderstood how this bomb works, and grossly underestimated its destructive power. Although some of the companies eventually found the right strategy, they lost more market share and spent much more on public relations and other remedial measures than if they had armed themselves in advance with the arsenal of effective defense weaponry. THE SUING GAME explores the right way to respond to accusations of discrimination, giving specific advice on how to evaluate a situation quickly and accurately; how to defuse media interest; and how to maintain the trust of customers, investors and employees.
